By accessing the Jerkmate platform, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and you must discontinue use immediately. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms, and you waive any right to receive specific notice of each such change.
1. Eligibility and Age Restrictions
The Jerkmate platform provides access to adult-oriented content, live video chat, and dating features. Due to the explicit nature of the content hosted on this network, strict age restrictions apply. You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction of residence, whichever is greater, to access or use the Site.
By registering for an account, purchasing tokens, or simply browsing as a guest on Jerkmate, you represent and warrant that you meet this age requirement. We employ rigorous verification processes. If we discover or suspect that an account has been created by a minor, or that a minor is accessing the platform, we will immediately terminate the account, forfeit any virtual balances, and block the associated IP address. Any attempt by a minor to access Jerkmate is a direct violation of these Terms and will be met with zero tolerance.
2. User Accounts and Registration
While portions of the Jerkmate platform may be accessible as a guest, utilizing premium features, saving preferences, or engaging in private cam-to-cam shows requires the creation of a user account. When creating an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account.
You agree to notify Jerkmate support immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation. You may not sell, trade, or otherwise transfer your Jerkmate account to another party without our express written permission. We reserve the right to suspend or terminate accounts that remain inactive for extended periods or that violate any community guidelines.
3. Virtual Currency, Tokens, and Payments
The Jerkmate ecosystem utilizes a virtual currency, commonly referred to as "Tokens," which allows users to access premium content, tip broadcasters, and initiate private shows. When you purchase Tokens on the Jerkmate portal, you are purchasing a limited, personal, non-transferable, non-sublicensable, revocable license to use those Tokens strictly within the platform.
- No Cash Value: Tokens are not real money, do not possess any real-world monetary value, and cannot be redeemed, exchanged, or refunded for cash, fiat currency, or any other tangible asset from us or any third party.
- All Sales are Final: Due to the digital nature of the Jerkmate services, all purchases of Tokens and premium subscriptions are final and non-refundable. If you experience technical issues during a private show, you must contact customer support within 24 hours for a review.
- Chargebacks and Fraud: Any attempt to initiate a fraudulent chargeback through your credit card provider or bank will result in the immediate and permanent ban of your Jerkmate account. Furthermore, we reserve the right to pursue legal action to recover the disputed funds and associated administrative fees.
4. Acceptable Use and Community Guidelines
To maintain a safe, respectful, and entertaining environment for both viewers and broadcasters, all users must adhere to the Jerkmate Community Guidelines. As a user of the Site, you agree not to:
- Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Make any unauthorized use of the Jerkmate services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email (SPAM).
- Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content.
- Harass, annoy, intimidate, or threaten any of our models, broadcasters, employees, or agents engaged in providing any portion of the Site to you.
- Broadcast, upload, or transmit any material that depicts or promotes illegal acts, non-consensual content, bestiality, violence, or any content involving individuals under the age of 18.
- Attempt to bypass any territorial restrictions or geo-blocking measures implemented by the Jerkmate network.
Violation of these acceptable use policies will result in immediate termination of your access to the Jerkmate platform without refund or notice, and may subject you to civil and criminal liability.
5. Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws.
When you participate in a live stream or chat on Jerkmate, you agree that you will not record, screen capture, distribute, or otherwise reproduce any part of a model's broadcast without their explicit consent. Unauthorized distribution of content from the Jerkmate platform is strictly prohibited and actively monitored by our legal team through digital rights management (DRM) technologies.
6. Disclaimers and Limitation of Liability
The Jerkmate platform is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Site, the accuracy or completeness of the content, or that the Site will be uninterrupted, secure, or error-free. You expressly agree that your use of the Site is at your sole risk.
To the fullest extent permitted by applicable law, in no event will Jerkmate, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if we have been advised of the possibility of such damages. The platform acts as a conduit connecting users with broadcasters, and we do not assume liability for the actions, promises, or behaviors of independent models broadcasting on the network.
7. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Jerkmate Services; (2) breach of these Terms and Conditions; (3) any breach of your representations and warranties set forth in these Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and defined following the laws of the jurisdiction in which the holding company of Jerkmate resides. You irrevocably consent that the courts of that jurisdiction shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
Binding Arbitration: If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute will be finally and exclusively resolved by binding arbitration. You understand that without this provision, you would have the right to sue in court and have a jury trial. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA").
